OVI Defense

In the State of Ohio, an OVI – Operating a Vehicle while Impaired – charge originates when it is suspected that a driver is under the influence of alcohol, drugs, or some combination of them.

In Ohio, anyone over the age of 21 driving with a blood alcohol content (BAC) level of .08% or higher is considered to be impaired. The BAC levels are even lower if you are under 21 years of age (.02%). Impairment levels for drugs can also give rise to an OVI; these levels depend on the type of substance found in a blood or urine test.

Penalties for OVI can be severe. A first offense can result in a one-year license suspension, three (3) days to six (6) months in jail, and hefty fines.

The good news: you can fight these allegations, even with the submission of a chemical test. Defenses can include faulty testing equipment, unqualified testing personnel, improper procedures during your arrest, or a lack of probable cause the initial traffic stop.

One of the most stressful components of any OVI charge is the prospect of having your license suspended. A suspension can impact your employment, family, and reputation.
